He is being tried in Iraq because his crimes are against the Iraqi people. Iraq is a soveriegn nation now and they will determine the crime and punishment for Saddam Hussein. Saddam Hussein is an Iraqi citizen and is being tried by an Iraqi court, and he is going to be sentenced to death.
