Very doubtful EULA would have something in there that would allow them to do that.

the thing is the warden client or anything to premit them to do what they are doing is not at all withen the eula or the TOS so one sue happy jackass could walk away with a nice settlement if they are smart enough...

A EULA is legally binding, you don't sign anything, sort of. You put your computers name & CD key to it, meaning, bam you have DIGITIALLY signed a contract that legally binds you to following the Exceptable Uses Licence Agreement. Ever heard hacking is against the law? Well, it is, because you are breaking one of the EULA agreements, hence giving them the ability to ban your CD key/hardware (thank you fucking punkbuster)/user name, you name it, without having to pay you or give you another CD key in "oh sorry, here ya go, cheat on this."
