Dude, you are right on the limit. You can get experts to testify that the machines are somewhat inaccurate, and that blowing that amount you couldbe alittle higher OR a little lower. When this happened to me, I blew .09, limit is the same here .08. Here in Canada you usually get charged with 2 counts: 1) Driving over the limit and 2)Impaired driving. The difference being the first one is specifically for you Blood Alcohol Content being over the legal limit, and the second charge you can be charged for having too much cold medicine. I was never prosecuted for being over the limit as they knew we would beat that, and the second charge is very hard to prove beyond a reasonable doubt, so I won in court. I dunno about there but here it is a Criminal Offence and you get a Criminal Record, so pay a lawyer with a credit card and beat the damn charge.

I just turned 21 a few days ago, and my friends and I went to a bar and I had a few beers, not much to drink because I had work in the morning. Anyways we all went in my car and I drove off then this cop comes from no where and pulls me over for an out headlight. Anyways he smells alcohol on my breath makes me do all these tests (which I passed) then he had me do a breathalizer and I blew a .08 which is the limit so now I have a DUI. If I blew .07 I would have been free to go. Now I'm fucked I'm thinking about getting an attorney but their fucken $3000 for the cheapest and I have no money and no one seems to want to give me a laon.

im not sure if the law in whatever state you're in is the same as the law here in ontario, but if the only test that they gave you was a "roadside breath test" i.e. pass-fail test (the roadside test gives only pass-fail), then you would've been taken to the police station and take the "official" test (the breathalyzer, or the Borkenstein test). the roadside test only gives the police grounds to take you to the police station, but if you managed to sober up while you've been taken to the station, then you are okay.

 

btw, on and over .08 is the limit for a DUI charge, but in here, if you have .06, then you would have your license suspended for 24 hours (which is a pain in the ass, but no charges though).

 

if in the states, they used a "portable breathalyzer" on you (never knew that those exist) and you get busted, then i would guess it's as good as a Borkenstein test.

 

 

anyways, good luck get a good lawyer, you might come up with a good defense (you never know) and don't drop the soap :naughtyd:

i thought the breathalizer couldnt be the only thing to get a DUI? i mean if you passed all the tests they you shouldve been let go.

How did you guys get a DWI for drinking instead of DUI? driving while intoxicated != driving under influence, the latter being alcohol and former everything else.
