With a lawyer you will definitely get it dropped down to a negligent driving or if your lawyer has an in with the prosecuting attorney it may be dropped altogether. If you just go in there and let them have their way with you with no representation you are a fucking moron. On a side note, .08 is bullshit. Thats like two beers. Practically everytime I drive at night I am at risk for DUI (in Washington anyway). So don't be a dipshit and get a lawyer. Not one of those court-appointed fucks either. A REAL LAWYER. December 4, 200519 yr I just turned 21 a few days ago, and my friends and I went to a bar and I had a few beers, not much to drink because I had work in the morning. Anyways we all went in my car and I drove off then this cop comes from no where and pulls me over for an out headlight. Anyways he smells alcohol on my breath makes me do all these tests (which I passed) then he had me do a breathalizer and I blew a .08 which is the limit so now I have a DUI. If I blew .07 I would have been free to go. Now I'm fucked I'm thinking about getting an attorney but their fucken $3000 for the cheapest and I have no money and no one seems to want to give me a laon. You know one second your living life and having a great time, then the next thing you know some shit comes your way and now your fucked. a friend of my recently was WASTED and slid right ofthe road, through a fence, onto another persons property, and fled the scene. he got a great lawyer and got all of the charges dropped. if you want to clean your record i would suggest getting a lawyer... also, you should of denied taking the breathalizer, this makes them have to bring you down to the station and take a lot of time which could give you enoguh time to wear off the booze, plus when you deny it, it makes you seem sober, as no one sober wants to get out of their car and take a breathalizer. i know in canada you can deny taking the breathalizer, im not sure about the states. the best offence is a strong defence, you gotta know the laws and how to use them. good luck with everythign though, thats a shitty deal. and by the way shut the fuck up to anyone saying " OH MY GOD YOU DRANK AND DRIVE YOU RISKED LIVES" he hada couple drinks and was fine to drive, stop being pussies

December 4, 200519 yr yeh if you're guilty, might as well deny it in the states refusal of breathalizer, they ask for blood sample, refusal = mandatory 1 year probation. adult probation = no PO, no urine tests, just dont get in trouble.

He didnt put anyone at risk, I don't know about you but .8 is not a lot at all. The states usually set the limit considerably low depending on how many DUI accidents occure in the state. I garuntee half of the kids that are bitching about you drinking and driving just graduated the DARE program atleast two years ago. I don't think your punishment will be very harsh at all considering you were only .1 over. The police officer should have your awareness or w/e test on camera. And if you truly did pass the other test then you should get off with a fine and maybe having to attend some classes. And just like everyone else said just go with it. Since you are not under the legal drinking age than tell the judge you have learned your lesson blah blah maybe get some community service no harm done. btw- If you have a job and are going to school than that will also play a huge roll in your license gettig suspended.

If anything it should make it to where I have a less of a chance of getting my license suspended. Well looks like I won't be getting a lawyer, no place will give me a loan and I can't get the cash soon enough before my court date. So I'll just get a court appointed attorney and hope for the best. BTW whoever said that a .08 is more than just a few drinks is a fucking retard I have the slip in front of me from the DMV that says drinking 3 beers at 130-149lbs (my weight) would be more than a .08. In fact if I drink 2 beers is says I'm at risk for a DUI.
