It's all about money. Despite the fact that people think that its not that big of a deal, as soon as it starts to affect the pocketbooks of the upper class it is looked at as if it is almost as bad as some of the other crimes. OK..let me start off by saying I think P2P should be legal...but I understand if it needs to be regulated and charged for, and some of the proceeds sent to the companies who produce the "items" traded via P2P.

 

BUT...

 

Free file sharing isn't just part of your "right to do what you want"...as a matter of fact, there is no such right...and your personal freedoms to "fo as you want" END the instant the infringe upon anyone else's rights, legally...and they always have.

 

By copyrighting something, you have staked, and proven claim to, intellectual property...you have a RIGHT to the proceeds from it after that...and a right to control distribution, etc, etc.

 

I mean...how would any of you feel if YOU invested thousands of hours into desiging a game, borrowed a couple million dollars to mass produce it, market it, and so on, HAD to pay that money back, no matter what happened to you, short of bankruptcy, which would mean giving up your house, your car(s), your credit cards, and any other assets you had, and not having a snowball's chance in Phoenix in July of replacing them with something similar for at LEAST 7 years...and then the instant you released it for sale, the first guy who bought your $50 game made an image of it, and posted it on a P2P server...and within a week, anyone who wanted it could have it for the buck a blank CD cost them, instead of paying you your $50?

 

OR, if you spent a year working full time to write a book, living off your savings, just to have some jackass copy it into an unauthorised e-book immediately, so you didn't make enough to even cover the publisher's $3000 advance to you? Nice, eh? A year of working full time to make $3,000 total?

 

OR, if you were a musician, who due to lack of record sales, couldn't take time off from touring to write, compose, and practice/publish any new songs, if you wanted to make enough money to get to the point you could produce your own records and promote your own concerts, so you didn't have to pay 95% of the income from your art to leeching managers, promoiters and producers? How long would your carreer last if you only got to put out ONE popular album, and had to make enough off of touring that ONE album (just touring, not off the album itself) to provide enough money to YOU that you could afford for the whole band to take off six months or a year to compose new material, then have enough left over to get the wheels rolling on the NEXT album, just so you could tour off THAT one long enough to do it again? (the days of the multimillion dollar rock star would be over, for damned certain)

 

 

 

I'm not saying that the largest portion of money paid for a CD, game, or book doesn't go to parasitic leeches who don't DO anything worth the percentage of the proceeds they get, comparitavely...nor am I saying that the producers, publishers, agents, and such should get paid as outrageously as they do...they shouldn't...someone managing one big name band should make about as much yearly from doing so as someone managing a largish sales area for a product vendor...a producer who has one BIG name to his credit should only make about as much as a local goods producer, and so on, and so forth, if you're going to keep things balanced....but what I AM saying is that P2P DOES hurt the "artist", at the same time that it deprives the parasites who SHOULD be deprived of their leeched income.

 

Personally, I'd be willing to see it set up so that P2P was legal as a sunbscription service, where you had to pay either a monthly fee to belong to the "club", or where you were charged by the amount of data you downloaded...so long as the way it was set up, a portion of the funds involved were sent directly to the COPYRIGHT HOLDER of the material on the "hub" (not to the record label, or anyone else, but in checks that would compare to the amount the artist would have made themselves if that number of singles had been sold)

I see your point, except musicians make most their big dollars touring, not off record sales. The big businesses are going after p2p because it is them losing the most money, not the artists themselves.

I agree entirely with that...however record sales (and obviously this ONLY applies to music) is what allows musicians to advertise the tours, get the songs popular enough to ensure attendance to the concerts, and to "pay the bills" hile they're producing the NEXT record so they can go on tour again to make their "real money"

 

But...what about authors?

 

What about the coders who work on a game "on spec"? (or any other program)

 

Actors who work for a percentage of gross? Screenwriters who work the same way? Any other CREATIVE person involved in the process of producing the product, whose income relies on the product being SOLD, not just being made?

 

I mean fuck the nuts and bolts people who make huge money bbecause they manage to get into the "building" portion of a buisness that only exists because of the efforts and ingenuity of creative minds...no problem, as far as I'm concerned, someone who owns a record studio shouldn't get any richer than someone who owns a...auto mechanic's shop, for instance..or anything else that you make your living at because you have technical knowledge of a not-too-esoteric nature, that pretty much ANY goon could learn to do. But the CREATIVE folks who actually put together new stuff for us to enjoy deserve to be recognized...and even to get rich...because they have something that not just any idiot can do.

If the music industry didn't put out so much crap, p2p wouldn't be an issue. As it stands right now, the most common reason anyone download's a mp3 off any p2p program is because they simply want the one or two good songs they like, and don't want to have to buy the entire cd. These people wouldn't have bought the cd anyways, and most try to get to a concert of thier favorite bands. I'm so fucking sick of groups like the RIAA that believe if p2p was to go p00f then their record sales would instantly go up. Wrong assholes, your record sales suck because the cd's that are coming out generally blow shit.

 

Movies on the other hand are a different case. You don't pay 20 bucks to see 15 movies, you buy them for a 1 to 1. People that pirate movies by downloading them off a p2p have every right to go to jail. People that go to the movies, see the movie of their choice then go home and download it off p2p shouldn't have anything to fear, as you've already paid to see it.

 

Pirateing software by downloading the ISO off a torrent would fall under the "You're fucking screwed" bill. There isn't a sole reason why you would download a game that would make it legal. However software such as NO-CD cracks, CD emulation and such are legal because they offer enhanced features for people with the cd.

You know...You could set up some type of system on your computer to automatically erase your hard drive incase of a security breach (i.e. teh POLICE)

when you're not home. Like if it's tampered with, have sp0rkeh auto execute or have some type of huge ass magnet open up and corrupt your hard-drives or detonate your HD's with M80's ...make you sure you have backups of everything hidden somewhere. I only buy CDs of artists I enjoy. I became a fan of thier music from p2p. Some of the songs I have are older music that would be a bitch to try and find. Fuck that!
