You and I BOTH know they can't...however, it got me thinking in another direction... I recently did 30 days in county for violating my probation by commiting "felony threats"...All I did was tell a guy on campus to chill it before I beat his ass...fucker knew I was on probie, and called the cops, claiming he'd believed me, and was in fear of his safety.... Well...I did a little looking into shit on findlaw.com, and discovered something that COULD be fun for rages... If anyone directs a threat of bodily harm or death towards anyone else, which the "victim" believes to be real, the person who made the threat is guilty of felony threats (class C felony..1-5 years at state level, 5 to 10 or up to $25k in fines if it occurred across state lines) What this means is if, while you are raging, someone threatens to punch you, beat your ass, hunt you down and kill you, or anything else...all you gotta do is claim to have believed it, and been afraid, and they are guilty. How is this useable? Well...think about it...if the hosting company that rents the server out doesn't take action, despite having access to the logs, they are, by definition, accessories to a felony. Think about how US courts treat companies that are charged in such cases for not taking action? HINT: companies fire guy for looking at women the wrong way to prevent being accused of complicity in sexual harrassment, these days. Translation...if you can get screenshots or other proof of such threats being made towards you while raging...YOU aren't breaking any laws by raging...THEY just did. Send the host company a copy of the "proof" and a nice legalese letter stating that if they don't take action against the "offender" you will include them in the felony charges as accomplices for complicity. A quick form-letter e-mail with attachment, and you will get "threatening" players banned, admin fired and banned, or possibly even get the server shut down by the hosting company...now how's THAT for a way to piss them off? I realize this is a bit long and involved for most ragers....but why stop at crashing servers? If it annoys them to be crashed, imagine how much it will annoy them to be told they have to ban friends and regs for saying the wrong things, or fire an admin, or if they lose their server entirely? (Even more fun....imagine doing this to some of the old Christian fundy group servers?)

Both JAPS and myg0t are involved in illegal activities as well. Crashing servers is illegal. That's a DOS attack! The server owners could prosecute them. You have their IPs. Go get a subpoena!!! As a victim, YOUR actions aren't subject to inspection, as long as what YOU were doing and saying at the time was legal in the strictest sense of the word...and last I checked, raging, gamecheating, etc, was completely legal. This isn't a rape case, where the defense could investigate your sexual history, etc...this is straight out "I was threatened, and I believe he can and will follow through...WAHHHHH"..prove you were threatened, and that's all it takes. On top of that...I'm also NOT suggesting actually going to the cops...I'm saying that IF you write up a nice legalese form letter to e-mail to the hosting company for the server, and include documentation of the "offense", THEY are legally responsible for supporting a felony crime, if they don't take action against the offending party....just like Wal-Mart or the administration of a public school is held accountable for assaults on their property if they do nothing to try to stop or discourage them. Basically, use aggressive social engineering against US server hosting companies to use their legal accountability against them...if they know of illegal activity going on on their servers, and they do nothing to stop it, they are liable...so you make them aware of it, and that FORCES them to take action...the least of which is requiring the person who made the threats be banned from that server...probably from all their servers, and with high liklihood, if it was an admin, they'll refuse to continue doing business with the group who's committing the "offenses"....no cops involved <grin>

An important rule of thumb is do not toss threats around while raging, just fuck aorund in the game exploiting whatever you can until it gets the fuckers boiling raged. Then they start the insults, stay calm until everyone goes nuts and tell them that you will call the cops on them because they're racist and so and so. They all start leaving. Your ISP and or the game server host has nothing against you, they have no grounds to sue.

ANYHOW Techno, that's exactly what I'm saying, dude...if you play it right, you can rage a server, never do anything illegal at all, gather proof of the technically illegal actions of other players and/or admin, and take those "proofs" to the hosting company. If it's a US based company, US law says that if they don't take action against the individuals who broke the law on their servers, THEY are liable...and if they don't know it, the first lawyer they ask will tell them. A simple e-mail in legalese citing felony harrasment laws by code and section (use findlaw.com to find the areas to quote and cite), followed by the definition of "accessory after the fact" also found on findlaw, and a statement that you believed the threats, are in fear of them being carried out, followed by a demand that the hosting company "take action to stop this harrassment, or be held liable for complicity" should do the trick :)
