Posted July 17, 200816 yr well what happen is we were both drunk and kinda pushed each others buttons, after a while we just couldn't take it and started fighting for a while, i got him few times really good and he got me too, he ended up being bruised more, the next day he came back to my door, i open it and he was standing there i diden't think i would see this guy again for month, with my surprise, he takes something out of his pocket, it was pepper spray, and starts spraying me with it, right after, i was blinded, he started hitting me with the metal pepper spray, and i just went defense mode, knowing if i try to fight back he would either A) destroy my apterment and the paintings i have, or B) if i called the cops on him, we both would have gotten arrested, well anyways after he left i called 911 and told him the story, i dident mention to much of the fight we had yesterday but did tell them we did fight, also hes 50150 which is legally insane, and on top of that he got kicked out of the army... knowing him, he doesn't like the idea that hes in jail now, and is most likely trying to build a case against me, what do you think he could say, like that the fight was started by me the day before and he just came back to finish it? he drove me and my cousin and my friend back home and i sat next to him in the front seat, he dident hit me then, i told him i wont fight anymore so if he hits me go ahead, i'm not really worried but i do want to prepare for myself, if he throws something at me, i want to be ready for it, can you guys help me out, .. so please help me out on this and tell me what possibility could happen, and even so, would i go to jail too, or would i get probation?

July 17, 200816 yr Author honestly the reason why he came back is cuss i bruised him up reallygood, i kicked him and punched him, i know tak wan do, and pretty much most shots he got against me i blocked and counter, and even in the car i punched him bunch of times and kicked his face against hes windshield window, hes just pissed off cuss he lost the fight, even if he trys to finsh the job, ill be expecting him, with a huge ass knife, and hammer all he has to do is step into my building again, i know what hes trying to do is say that the fight wasent over from last night, and that i started it , but if the fight dident finsh, why did he give me and my friends a ride home, and why dident he use the opprtunity to fuck me up again, as i came and sit in the front seat with him he dident do shit, speaking of money for the car, i am thinking of taking this to civil court after he gets sentence, a layer told me that, what can i do to sue him , and what can he say that will get me in trouble too, (i honestly think if he story is belived, i will get probation or community service, no jail) anyways thanks for the advices i take them all serious, besides the trolls.

July 17, 200816 yr Doesn't matter if you had a fight the day before or anything that happened prior to him attacking you. He is guilty of assault for coming to your home with the purpose of assaulting you. The only thing he could do now is try and get you arrested for assault from the fight the night before. Based on your story though, it was a mutual fight and you both have been drinking, so I doubt the cops are going to charge anyone because it would be difficult to prove who started it. As far as suing him goes, it's an option, but one you are not likely to get any money from. Even if you won a civil case against him you are only looking at getting money for medical bills and property damage. It is also very difficult to actually collect money in a civil lawsuit vs another person. Unless the person just deceides to pay you after winning the case, it will normally take you going to court again to try and garnish wages from them to collect your money. Then all they have to do is change jobs to stop this, since the wage garnishment is setup with the current employeer and doesnt automatically follow if they switch jobs. Making you have to go to court all over again to start the wage garnishment with the new job he gets it. Find a better class of people to hang out with. July 17, 200816 yr Being in a number of fights myself I'll tell you this. He can't press charges now that he came to your door and attacked you. Regardless of what happened prior. Your best bet is to let him think he won (however that works?) and move on.
