first off, a procedure does not prove that they indeed would do so in this case. it merely proves that they could. could =\= would.

 

Blumenthal v. Drudge involves defimation of a specific individual. No specific individuals were defamed in this incident. Merely a disruption of a public internet chat room.

TheHatter is right that the incident reflects a specific person, but it is the likelihood of using your first Amendment rights to defamate another person or group of people that is presented. You have a right to speech just like you have a right to be free from defamation or libel. If someone is calling you a "nigger," "spic," "gook," etc and you do not like it, regardless of what form of communication it is interpreted in, then you have a right to file charges against the offender.

Neither is a newspaper but libel extends its branch through there. Look, the term "place" is ambiguous. It also represents the medium of communication where the use of speech is being used. If I call you up on a phone and call your mother a "sandnigger," that is defamation. If I write in a newspaper article that you are a homosexual, that is libel. If I type up on the Internet in public chat that Chunkylover56 is a Jewbag, that is libel and harassment since it is real time.

But those racial slander terms were not being used on certain individual's. They were being used in general population. Well, now wait... I did say "Nigger's like yourself." So that could be considered harassment. But I seriously doubt the Police are going to give a fuck that I called someone a nigger. Hell, the cop's in this city are so racist. In my opinion David is completely correct. However, at my university a professor wrote an essay about how the victims of 9-11 were a bunch of nazis and nothing happened to him. No lawsuit, no loss of job, nothing. Obviously a lot of people got raged.
